It is your sole responsibility to check the Seller Portal, Website, and this Guide, including what has changed here, for any relevant changes.

INTRODUCTION

What is the compliance guide?

  1. Takealot's mission is to be the most customer-centric shopping destination in Africa. Our company is built around the simple concept that the customer comes first. Our success is based on our ability to delight customers with amazing service and a one-stop destination where they can find any product they can think of. To ensure we live up to this promise, we have this Compliance Guide (Guide), our Selling on Takealot - Terms and Conditions (Terms and Conditions), Service Level Agreements, our Website, standard operating procedures and various other guides which outline minimum performance and compliance levels we require all Sellers to meet. Similar to every business, Takealot has legal obligations to adhere to, and compliance is an integral part of a successful business. It is for this reason that this Guide is a necessary tool for Sellers to sell successfully on Takealot.

Why is the compliance guide important? 

  1. Compliance is important to Takealot as it ensures the safety of customers and that product offerings are authentic, of good quality and in good working condition. Without a comprehensive legal framework for compliance, our customers will be susceptible to products that could potentially cause harm and, in turn, have a negative impact on the business. Sellers are therefore urged to follow the standards set in this Guide, all laws & regulations in the Republic and other related documents that Takealot may issue from time to time to promote the safety of customers.

What happens if I do not follow the Guide? 

  1. Compliance with this Guide and all laws of the Republic is not optional. It is your responsibility as a Seller to familiarise yourself with all laws, regulations and guidelines applicable to your trading on Takealot.

Sellers who are non-compliant and/or deliberately circumvent the rules set out in this Guide and our Terms and Conditions will have their Seller Account permanently suspended/terminated.

DEFINITIONS

  1. The following definitions apply to this Guide in reference to the Terms and Conditions
  1. "Brand” is a particular name, symbol, feature or idea attributable to a particular product name. A brand might be protected by intellectual property;
  2. Branded Products” means products connected with a particular name, symbol, particular features, or ideas in order to make people recognise and want to buy it. Branded Products  might be protected by intellectual property;
  3. Counterfeit Goods” means goods that are the result of counterfeiting and includes any means used for purposes of counterfeiting (Counterfeit Goods Act);
  4. Customer(s)” means any customer or potential customer on the Website;
  5. Complementary Medicine” means any substance or mixture of substances that originates from plants, fungi, algae, seaweeds, lichens, minerals, animals or other substances as determined by the South African Health Products Regulatory Authority (Authority) and is used or purporting to be suitable for use or manufactured or sold for use:
  1. in maintaining, complementing or assisting the physical or mental state; or
  2. to diagnose, treat, mitigate, modify, alleviate or prevent disease or illness or the symptoms or signs thereof or abnormal physical or mental state of a human being or animal.

And the above is used:

  1. as a health supplement; or
  2. in accordance with those disciplines as determined by the Authority (Medicines and Related Substances Act);
  1. "Dealer” means a person who carries on a business of dealing in second-hand goods (Second-Hand Goods Act);
  2. "Foodstuff" means any article or substance (except a medicine as defined in the Medicines and Related Substances Act, 1965 (Act No. 101 of 1965)) ordinarily eaten or drunk by a person or purporting to be suitable, or manufactured or sold, for human consumption, and includes any part or ingredient of any such article or substance, or any substance used or intended or destined to be used as a part or ingredient of any such article or substance (Foodstuffs, Cosmetics and Disinfectants Act);
  3. Genuine goods” means products that are produced and distributed with the authorisation of the trademark owner;
  4. "Including” or "includes” means including without limitation to or includes without limitation;
  5. "Intellectual Property" means intangible assets including but not limited to artistic works, inventions, designs, symbols, names and images created by a person's intellect;
  6. Listing Information", in relation to a product, means the information illustrated in the product description page of a product on the Website;
  7. "Medical Devices" means any instrument, apparatus, implement, machine, appliance, implant, reagent for in-vitro use, software, or material intended by the manufacturer to be used, alone or in combination, for humans or animals, for one or more of the following:
  1. diagnosis, prevention, monitoring, treatment or alleviation of disease;
  2. diagnosis, monitoring, treatment, alleviation of or compensation for an injury;
  3. investigation, replacement, modification or support of the anatomy or of a physiological process;
  4. supporting or sustaining life;
  5. control of conception;
  6. disinfection of medical devices; or
  7. providing information for medical or diagnostic purposes by means of in vitro examination of specimens derived from the human body;

and which does not achieve its primary intended action by pharmacological, immunological or metabolic means, in or on the human or animal body, but which may be assisted in its intended function by such means (Medicines and Related Substances Act

  1. Medicine” means  (a) any substance or mixture of substances used or purporting to be suitable for use or manufactured or sold for use in:
  1. the diagnosis, treatment, mitigation, modification or prevention of disease, abnormal physical or mental state or the symptoms thereof in humans; or
  2. restoring, correcting or modifying any somatic o, psychic or organic function in humans; and includes any veterinary medicine (Medicines and Related Substances Act
  1. Parallel Import” means branded goods that are imported and sold in South Africa without the consent of the owner of the trademark or the authorised distributor;
  2. Product(s)” means any product that is made available for listing and offered for sale on the Website and/or is sold by the Seller making use of the Services;
  3. "Product Information", with respect to each product, means the following:
  1. title;
  2. description;
  3. categorisation within each Takealot product category and browse structure, as prescribed by Takealot from time to time;
  4. digitised image that accurately depicts only the Product complies with all Takealot image guidelines, and does not include any additional logos, text or other markings;
  5. any text, disclaimers, warnings, notices, labels or other content required by applicable law to be displayed in connection with the offer, merchandising, advertising or sale of a Product;
  6. indication of whether the Product is a "grey good" or parallel import if applicable;
  7. brand;
  8. model;
  9. technical specifications; and
  10. any other information reasonably requested by Takealot;
  1. Product Listing” means the corresponding Product listing(s) on the Website;
  2. "Refurbished” means goods that have been reconditioned, rebuilt or remade;
  3. Return Policy” means the Returns Policy published on the Website from time to time;  
  4. "Second-hand goods" means goods which have been in use by a person other than the manufacturer or producer thereof or a person dealing therewith for such manufacturer or producer in the course of business, but does not include goods with a value of less than R100 (Second-Hand Goods Act);
  5. "Schedule 0 Medicine" means Medicines containing one or more substances, none of which bears a Scheduling status higher than Schedule 0, are indicated for minor diseases or symptoms which can be easily recognised by the customer and which do not require medical diagnoses or monitoring (Medicines and Related Substances Act);
  6. "Seller Portal" means the online portal, tools, guides and related documentation made available by Takealot;
  7. "Trademark Owner" means a brand name, a slogan or a logo. It identifies the services or goods of one person and distinguishes it from the goods and services of another;
  8. Veterinary Medicine” means any substance or mixture of substances other than a stock remedy or farm feed to be registered in terms of the Fertilisers, Farm Feeds, Agricultural Remedies and Stock Remedies Act, 1947 (Act No. 36 of 1947), used or purporting to be suitable for use or manufactured or sold for use in connection with vertebrates, for the treatment, diagnosis, prevention or cure of any disease, infection or other unhealthy condition, or for the maintenance or improvement of health, growth, production or working capacity, or for curing, correcting or modifying any somatic or organic function, or for correcting or modifying behaviour Medicines and Related Substances Act;
  9. Website” means the Takealot website accessible at www.takealot.com unless stated otherwise.


PROHIBITED PRODUCTS: PRODUCTS THAT ARE NOT ALLOWED TO BE LISTED ON TAKEALOT.COM

  1. Certain products are prohibited from being sold in South Africa due various reasons such as:
  1. to storage limitations;
  2. regulations; and/or
  3. occupational health and safety requirements.

  1. In addition to the above, Takealot may, at its own discretion, elect to not allow certain products to be listed on the Website for commercial reasons.

  1. The products set out below are prohibited from being sold on the Website.

Counterfeit Goods

  1. The sale of counterfeit goods is a criminal offence in the Republic of South Africa, and for this reason, the sale of counterfeit goods on Takealot is strictly prohibited. Any seller suspected of selling counterfeit goods will have their Seller Account immediately and permanently suspended. 


Any illegal material,

  1. This includes:
  1. any prohibited illicit or recreational drugs, including but not limited to drugs regulated by the Drugs and Drug Trafficking Act.
  2. elements which contain or consist of human body and medical implants.
  3. products regulated by the Convention on International Trade in Endangered Species of Wild Fauna and Flora, e.g. products made of or containing any or part of any plant or animal, will have the sale, storage, import or export of which is prohibited or regulated. This would include examples such as endangered species, elephant ivory, sea turtle shells, coral and most reptile skins.
  4. firearms, air guns, air rifles,  or any other similar device manufactured or designed to propel or discharge a bullet or any other projectile (including self-defence guns) of a calibre of 5.6mm (.22 calibre) and higher at a muzzle energy of more than 8 joules (6ft-lbs), and all associated gun parts, ammunition and kits. This would include spearguns, black powder, and all explosives, and offensive weapons as defined by the government of the Republic of South Africa, blank guns/Prop guns: a device which is not at the time capable of discharging any bullet or projectile but which can readily be altered to be a firearm. This includes blank guns and all associated parts, ammunition (including blank bullets) and kits.
  1. products containing prohibited images of children and any other violent, offensive, obscene or sexual content that is unlawful in the Republic of South Africa.
  2. vehicle identification lights regulated by Regulation 176 and Regulation 185 of the National Road Traffic Regulations, e.g. Blue, Red, Green, Amber and Orange lights.
  3. cigars, cigarettes, tobacco or other products containing tobacco, tobacco devices.
  4. products that cannot be lawfully shipped to or sold in the Republic of South Africa.

Goods prohibited due to commercial reasons, including:

  1. These include:
  1. products that are sensitive to temperature fluctuations or necessitate refrigeration throughout their storage and transportation.
  2. live animals and Taxidermy.
  3. loose gemstone or semi-precious stone products.
  4. metal gold, any metal of the platinum group, the ores of such metals, and any other metal defined as precious metals under the Precious Metals Act.
  5. gift certificates, gift cards and other stored value instruments.
  6. DVDs or Games that are not supported in the Republic of South Africa.
  7. any other types of products that, in our discretion are not supported for sale in the Republic of South Africa.
  8. products that do not comply with any agreement between Takealot and the seller.
  9. products with a selling price greater than (or equal to) R100 000.00 are not permitted for sale. Such offers will be blocked from displaying on Takealot.
  10. mattress and base/bed sets cannot be sold as a bundle or strapped together. Mattresses and bases must be packaged either in cardboard casing/box or two layers of thick plastic.
  11. products that will amount to animal cruelty, e.g. rodent glue, live capture trap, dog shock collars, etc.
  12. the sale of any coins or notes that are deemed to be legal tender is not permitted. This includes limited edition notes or coins issued by the SARB.
  13. services, including but not limited to extended service warranties, money-back guarantees, replacement plans, service contracts, buy-back guarantee programs, investment services, subscriptions, event tickets.
  14. fishing vessel or any gear, stake net, setnet, gillnet, driftnet, bottom trawl net, midwater trawl net, purse-seine net, purse-net, longline or any type of rock lobster trap.
  15. BAOFENG Model Number: UV-5R with Type Approval Certificate Number: TA-2018/870.

  1. Goods prohibited due to storage safety restrictions include:
  1. All flammable products, including but not limited to lighters, candle lighters, matches and fire lighters.;
  2. batteries containing water or acid that can be leaked; or that have to be shipped upright; or not packaged in a double corrugated box;
  3. fireworks and other pyrotechnics;
  4. hazmat items, flammables and oil-based paints; and
  5. any compressed gas/cylinders may only be sold without gas.
  6. bulky Items (exceeding 70 kg) and/or 4m in packaged width, height or length may not be sold without the express authorisation of Takealot. Please note that this restriction does not apply to White Goods, though White Good Sellers need to be authorised by Takealot.

  1. Goods prohibited due to regulatory restrictions include:
  1. Scheduled Medicines and certain classes of Medical Devices, in particular:
  1. health, beauty or veterinary products containing one or more substances which bear a Scheduling status higher than Schedule 0. Takealot only permits the sale of Schedule 0 and complementary medicines. All Sellers must adhere to listing requirements, including providing all ingredients on product information pages. Please refer to the knowledge centre here for more information on listing requirements. For the avoidance of doubt, refer to the SAHPRA's Consolidated Schedules 6 September 2024. This schedule is subject to change, and it is the Seller's responsibility to be up to date with the changes made.
  2. Continuous Positive Airway Pressure (CPAP) machine, Blood Type Test Kits, HIV Test Kits or HIV Self-Test Kits, Blood Glucose Test Strips, Ketone Test Strips, Automated External Defibrillator devices (AED).
  3. complementary medicines containing more than 600 mg of Cannabidiol per sales pack and a daily dose exceeding 20 mg of Cannabidiol.
  4. complementary medicines containing more than 0.2% of Tetrahydrocannabinol.
  5. colour blindness correcting Lenses, Contact Lenses and Contact Lens solutions.

  1. Prohibited due to intellectual property restrictions include:
  1. Recopied media: Media products such as (books, films, CDs, television programmes, software titles, video games, and so on) that have been recopied, dubbed, duplicated, or transferred without permission of the rights owner are illegal to sell and are prohibited. This includes:
  2. Unauthorised copies of books are prohibited.
  3. Music - Bootlegs, unauthorised soundboard recordings, unauthorised live concerts, unauthorised merchandise, etc. are prohibited.
  4. Films—Unauthorised copies of films in any format are prohibited. Unreleased/pre-released movies, trailers, screeners, unpublished and unauthorised film scripts (no ISBN number), electronic press kits, and unauthorised props are also prohibited.
  5. Photos - Unauthorised copies of photos are prohibited.
  6. Radio programmes & Concerts - Unauthorised recordings or copies of recordings of radio programmes are prohibited.
  7. Software - Re-copied or duplicated software in any format is prohibited.
  8. Television programmes - Unauthorised copies of television programmes (including pay-per-view events), programmes never broadcast, unauthorised props, unauthorised scripts and screeners are prohibited.
  9. Video games—Any video games sold on Takealot must be full retail versions. Recopied or transferred video games are not allowed and are, therefore, prohibited. This would include mod chips, silver disks, video game emulators, Sega boot disks, game enhancers, unauthorised video game compilations, unauthorised bundles of video game products, and unauthorised accessories.
  10. Transferred media - Media transferred from one format to another is prohibited. This includes but is not limited to: films converted from NTSC to Pal and Pal to NTSC, laserdisc to video, television to video, CD-ROM to cassette tape, therefore, anything from the Internet converted or transferred to any digital format, etc.
  11. Promotional media—Takealot prohibits promotional versions of media products, including books (advance reading copies and uncorrected proofs), videos (screeners), and music. These products are distributed for promotional consideration and, therefore, are not generally authorised for retail distribution or sale.
  12. Rights of Publicity—Any celebrity images and/or the use of any celebrity names cannot be used for commercial purposes without permission of said celebrity or their management. This would include any product endorsements that would use a celebrity's likeness on merchandise such as posters, clocks, mouse pads, and image collections in digital format, etc.

RESTRICTED CATEGORY PRODUCTS: PRODUCTS THAT REQUIRE PRIOR APPROVAL OR A LICENCE

  1. Certain products are restricted by Takealot and may only be listed and sold at our discretion. These restrictions are in place to comply with South African laws and to ensure that all products meet our safety and quality standards. Sellers must obtain prior approval before listing them on our platform. Approval is granted based on a review of the product and its compliance with relevant laws and regulations. Failure to obtain approval for restricted products will result in the removal of the listing and may lead to further actions, including suspension of the seller's account.

Products Restricted Due to Internal Mechanisms

  1. Takealot may restrict the sale of specific brands at the request of a licensed trademark owner of or products to authorised sellers only. This mechanism is designed to protect brand integrity, ensure product authenticity, and maintain consistent quality standards. By restricting who can sell certain brands, Takealot reduces the likelihood of counterfeit goods from being listed and sold.

Parallel Imports or Grey Goods

  1. These goods are often offered to our customers at considerably cheaper prices than the prices they would be offered if the goods had been sourced through authorised or approved distributors. However, due to the fact that these goods are not authorised, the manufacturers' warranties and after-sales support are not applicable.

  1. Our customers have a right to be informed that manufacturers' warranties do not apply to these goods. If such information is withheld when our customers buy such goods, they will be misled, and the practice of selling these goods would be unfair. We are a customer-centric organisation and wish to provide products to our customers at the cheapest prices while keeping them fully informed. Therefore, no Seller can list these goods without Takealot’s approval. All accounts selling these goods without Takealot’s express approval will be in breach of our Terms and Conditions and the goods will be removed from the Website and/or our distribution centres at the cost of the Seller. Where approval is granted to list these goods, all product display pages must include the term "Parallel Import" in the product title.

Large Appliances (“White Goods”)

  1. These categories are currently curated by Takealot and may only be sold with express consent. There is no application process for the sale of these goods at this time. Your account will be approached by a Takealot Representative for the sale of these products should your business be identified as a suitable vendor. All accounts selling these goods without express consent will have their products removed from the site and/or our distribution centres at the cost of the Seller.  

Refurbished Electronics

  1. The sale of refurbished electronic goods is curated by Takealot and will only be allowed to be listed upon approval. Listing in this category requires that an application is submitted on https://sellers.takealot.com/account-settings/compliance. Approval is subject to the required documentation being submitted. Takealot reserves the right to reject or accept applications to list products under this category.

Cannabidiol (“CBD” Oil) Products

  1. Takealot’s written approval is required for any Seller to market and sell Products containing CBD on the Website. In addition to the Product Warranty, a Seller authorised to sell such Products warrants that any Product consisting of preparations containing CBD will be processed, manufactured, marketed and sold in strict compliance with the Department of Health's Regulations regarding the exclusion of certain preparations containing CBD from the operation of certain provisions of the Medicines and Related Substances Act, 1965 (Government Notice 756).

Telecommunications, Broadcasting, Electronic Communications and other Related Products

  1. The Independent Communications Authority of South Africa (“ICASA”) regulates a range of products and services related to telecommunications, broadcasting, and electronic communications. Sellers must ensure that their products comply with ICASA regulations before they can be listed on Takealot. This ensures that products do not cause harmful interference and meet the country’s safety and performance standards. ICASA regulates products that communicate wirelessly, such as:
  1. bluetooth.
  2. wifi.
  3. cellular.
  4. 2-way radios.
  5. NFC (near-field communication).
  6. GPS (Global Positioning System).
  7. broadcast.
  8. ANT+ (Interoperability).
  9. RFID (Radio frequency identification).

  1. For these products to be compliant, ICASA requires the following:
  1. Type Approval: Certification that the product meets ICASA’s technical standards and does not interfere with other communications.
  2. Labelling Requirements: Products must display the ICASA logo to indicate compliance.

Products Regulated by the National Regulator for Compulsory Specifications

  1. The National Regulator for Compulsory Specifications (NRCS) in South Africa regulates a range of products to ensure they meet safety, health, and environmental standards. Sellers must ensure their products comply with NRCS regulations before they can be sold in South Africa. For more information on NRCS licensing please refer to the NRCS website here. Products that are regulated by NRCS include, but are not limited to the following large appliances, small appliances, audio equipment, hi-fi systems, electrical components and other products such as:
  1. refrigerators.
  2. freezers.
  3. stoves.
  4. dishwashers.
  5. washing machines.
  6. tumble dryers.
  7. vacuum cleaners.
  8. heaters.
  9. electric irons,
  10. heated blankets.
  11. fans.
  12. hairdryers.
  13. radios.
  14. cables LV -Low Volume.
  15. cables MV-Medium Volume.
  16. cord extension set with switches and ELPU.
  17. cord extension set with switches and MCCB.
  18. cord extension sets with switches.
  19. cord extension sets without switches.
  20. cord sets with plug and appliance couplers.
  21. earth leakage protection unit multi-phase.
  22. earth leakage protection unit single phase.
  23. flexible cords.
  24. baby car seats, 220v powered products, motorcycle helmets.

  1. For these products to be compliant, the NRCS requires:
  1. a Letter of Authority (LOA): issued for products that meet the requirements of the relevant compulsory specifications.
  2. adherence to labelling requirements: Products must display the NRCS mark indicating they meet regulatory standards.

CLOSED CATEGORY PRODUCTS: PRODUCTS THAT REQUIRE PRIOR CERTIFICATION FOR APPROVAL

  1. In addition to prohibited and restricted products, certain products fall under a closed category. This means that no Seller can list a product in this category until the appropriate certification has been submitted and verified. To sell a product under this category a Seller must submit documentation proving that the product meets all the respective regulatory requirements. Once the documentation is verified Sellers will be granted permission to list the product in the closed category. Failure to meet these requirements will prevent the Seller from listing on Takealot.   1. Medical Devices - Class A and B
  1. All products which are classified as a medical device, and are allowed for listing on Takealot must be accompanied by a valid medical device establishment licence issued by SAHPRA. Please note that Takealot will only permit the listing of Class A and B medical devices.

  1. There are three types of licences that are issued by SAHPRA namely, the Manufacturer licence, Distributor licence, and Wholesaler licence. Takealot only accepts Manufacturer and Distributors licences, you are not permitted to list on Takealot if you hold a Wholesaler licence.

  1. Licencing of Sanitisers 
  1. Please note that the licensing of sanitisers depends on the place of use and application surface of the sanitiser. The licencing is as follows:

  1. Food products - certification and labelling  
  1. The Foodstuffs, Cosmetics and Disinfectant Act requires that entities that trade in food must hold a Certificate of Acceptability (CoA- R638 certificate) as proof of compliance with Regulation 638 of the Foodstuffs, Cosmetics and Disinfectants Act. Please note that the following certificates will be accepted as compliance with food regulations: ISO 22000 certification, HACCP certification in compliance with Regulation 908 of the Foodstuffs, cosmetics and disinfectants Act, and FSSC22000 certification.

  1. All food product labelling must be affixed to the product packaging in English, and where possible one other South African language. All labels must be affixed in a manner that cannot be separated from the product or product container.
  2. Labelling of food products listed on Takealot as well as those delivered to the DCs must comply with the following minimum requirements:
  1. company name e.g. address, contact details of the business, website.
  2. product name and description.
  3. date manufactured.
  4. expiration date.
  5. list of ingredients including mass/composition.
  6. allergens including those at the packaging/storage facility.
  7. country of origin.
  8. storage instructions.
  9. intended use or instruction of use and warning.
  10. nutritional Information.
  11. batch number.


  1. NON-COMPLIANCE WITH LISTING REQUIREMENTS  
  1. Where your listings do not adhere to the above minimum requirements, they will be disabled until you have adhered to the necessary labelling requirements. This will require you as a Seller to send in the necessary images that demonstrate that your product complies with the labelling requirements set out above. Submit an Edit Request to update your listings accordingly which will be approved if compliant with the requirements set out above.


USE OF INTELLECTUAL PROPERTY AND BRANDING

  1. It is a seller’s responsibility to ensure appropriate usage of intellectual property and branding. As mentioned in section 3.1 of the guide, it is a criminal offence to list stolen intellectual property i.e. list counterfeit goods and immediate suspension is the result thereof. Further to this it is important for purposes of listing that you are using the appropriate intellectual property/branding for which you are registered for. Please read the information below and ensure that you understand what is required of you.

  1. BRANDED PRODUCTS 
  1. Sellers who wish to sell branded products which they are not a brand owner of must ensure they have the necessary permission and are granted consent from the brand owner to sell these products on Takealot. Sellers must present the proof of the consent to sell in order to list such products on the Takealot.

  1. BRAND OWNERSHIP
  1. Sellers that wish to sell branded products which they are brand owners of must register with the brand programme by presenting the following information pertaining to their listing:
  2. proof of registration at the CIPC.
  3. trademark certificate.

  1. Please note that listings for which a Seller  will be allowed to to sell depends on the brand category the Seller is registered for.
  2. Any listing of a branded product that does not contain consent from a brand owner or Trademark Certificate in the case of owned brands will not be permitted to list on Takealot.

  1. CUSTOMER RETURNS  
  1. We want our customers to be delighted with their purchases, and if they are not completely satisfied, we want them to return the product to us so that we may repair it, replace it, or credit their account. As a Takealot Marketplace Seller, you are expected to accept these terms as your own.

  1. LISTING MY PRODUCTS 
  1. Takealot's catalogue and offer framework is based on what we call the product display page. When you sell on Takealot you may create an offer against an existing product display page for the product. If there is no product display page for the product you may create a new product display page for it. Other sellers, including Takealot, could use the product display page you have created, to add their offers for the product. Adding a new product to the Takealot catalogue and subsequently creating a new product display page does not give you exclusive rights to that particular product or product display page.

  1. COMPLIANCE CHECKLIST 
  1. The following checklist provides a basic overview of key compliance requirements, however, it is essential to refer to the complete compliance guide for comprehensive and additional obligations.

Legally Compliant

Product offering is:

  • My trading name and the details of my company accurately reflect the details found in CIPC.
  • My listing is approved with an ICASA certification for all products that use radio frequency, excluding radios.
  • My listing is approved with an NRCS Letter of Authority for all products that require specific specifications to be approved for environmental health and safety standards e.g. baby car seats, 220V-powered products, motorcycle helmets etc.
  • My listing is approved with SAHPRA certification for medical products that fall under Class A and B.
  • My SAHPRA licence is valid and has not expired.
  • All the ingredients in my product listing are listed in accordance with SAHPRA rules.
  • My food product is compliant with all food labelling requirements, accompanied by a Certificate of Acceptability (“CoA”).
  • My product listing is compliant with all the Intellectual Property laws of South Africa.
  • Sellers who are VAT vendors must ensure they are registered as such and have provided us with accurate VAT numbers.
  • Not counterfeit and not stolen;
  • correct and truthful with no misleading or prohibited content; and
  • not a duplicate display page of existing products on Takealot.
