TERMS OF SERVICE

mizcommish@gmail.com

To commission me, one must first agree to the terms and conditions below.

IMAGE RIGHTS

All commissioned artwork is for personal, noncommercial use unless agreed upon otherwise. The commissioner can use commissioned artwork as an icon or banner, print a copy for themselves, etc; they may not resell the image, use for advertising or branding, or for any sort of profit. Certain commissions like emotes, badges, and pngtubers may be used on streaming or subscription services (ex. Twitch, Youtube, Discord) but cannot be resold elsewhere or used for other commercial purposes. Commercial rates are available upon request.

The commissioner is not allowed to alter my work without permission. This includes tracing, recoloring, or removing my artist’s signature. The commissioner is allowed to upload commissioned artwork in their own personal galleries or pages. Crediting by linking back to my own gallery when reposting is appreciated but is not required.

I retain full copyright over my artwork and may use completed works in my public galleries or as commission examples. The commissioner may not claim it as their own work or claim that it was created by anyone else.

PAYMENTS AND REFUNDS

Payment is required upfront. I use Paypal invoices exclusively for USD payments, and I will not start a commission until payment is received.

I will provide a full refund for commissions not yet started. A full refund will be issued if I choose to cancel the commission, regardless of progress. Refunds are not available at any other time.

I reserve the right to decline a commission at any time, for any reason, and without explanation.

WORKS IN PROGRESS (WIPS) AND REVISIONS

I will always provide WIPs for the following commission types: complex pixel animations, emotes/badges, pngtubers, and modding commissions. For other types,  WIPs may not be sent out unless requested by the commissioner.

The commissioner is allowed to request up to three free major edits (ex. pose, anatomy, changed clothing) during the sketch phase. Once the sketch is approved, only minor edits (ex. expression, color adjustments) may be requested. For animated pieces: once the static version is approved, no edits unrelated to the animation will be accepted. I reserve the right to refuse or charge extra for any edits that I find excessive or extensive.

Character designs will often be simplified, either to fit onto a smaller canvas size or to match my art style. For example, the number of fingers may be reduced or the face shape may be modified. Colors may also be adjusted slightly to achieve a certain mood or more harmonious color scheme. If the commissioner does not want these adjustments to occur, it must be mentioned beforehand and may be subject to a complexity fee.

IMAGE PRESERVATION

It is the responsibility of the commissioner to save any finished artwork sent to them as soon as possible. I will keep files on my own hard drive for at least 2 months. I may still be contacted for a copy after this time, but I cannot guarantee that I still have the original file.

I reserve the right to delete any artwork from my public galleries at any time, or refrain from posting them at all.
