ADOPT TERMS OF SERVICE

If you plan on buying an adopt or character from me, please read this T.O.S all the way through. Please note that this page may be updated at any time, it is up to you to refer to this before you purchase from me.

Please also understand that when you buy from me, you are buying MY art. It's sketchy, it may have mistakes, it’s a bit weird, but that’s my art! If you want a clean piece with crisp lineart and tight cellshading, that’s not something I can do! I will not draw in someone else’s style.

CLAIMING

• You may claim an adopt or character from me via Toyhou.se, dms, discord, twitter or furaffinity.

DO. NOT. CLAIM. IF. YOU. CAN’T. PAY. You WILL be blacklisted!

FILES

• The adopt files will usually be transferred via Toyhou.se or private message.
• No physical goods will be shipped, all work is done digitally.
• If the adopt is posted on toyhou.se, I require you to have a Toyhou.se account so I can track where my adopts go.
• Please do NOT hide any characters made by me on Toyhou.se. I cannot enforce this rule on other sites, and in general I still can’t really force anyone to do anything with their own characters, but please do your best to consider it. If you need to hide the character for any reason, please give me private rights to view the character.

TRADING/SELLING

• It is the responsibility of both users participating in a trade to fully read and understand these terms. In the event of a broken term, BOTH users may be punished accordingly.
• You may gift, trade, or resell this character if you no longer want them. If you have drawn or commissioned additional artwork of them - you may add the value of those art pieces to the sale price should you choose to sell them.
• If a design has alternate forms, "alternate universe" designs created by you or commissioned from another user that borrow design elements from the original design, these designs also transfer along with the character.
• Gifts received from me can be resold with my explicitly written permission for the price I set + the price of any other art purchased.
• MYO Slots in particular CANNOT be traded or sold for any reason. Trading or selling of finished, approved designs from the slots is fine, but you cannot make them with the intent to make them adopts.
• You CANNOT use my bases or species to make adopts with. You CANNOT claim my bases as your own art and you MUST keep the watermark where I placed it.

EDITS

• Do NOT under any circumstances edit my art!
• Please contact me about edits if you need them. If I forget something that was in the reference(s) provided, I will gladly change them without extra charge.
• I will make other edits with a small fee.

CREDIT

• If you repost a character that uses my base or my species, you must credit me somewhere in the description.
• You must credit me for ownership of the species. If the site allows links, a safe and working link back to my pages: [ FurAffinity / Twitter / Toyhou.se ] is required.
• If the site does not allow links, then one of the following is fine:

RIGHTS

• I retain rights to all images created, to be used and distributed in printed material or online sales.
• I retain all copyrights over my work, which include the right to redistribute, reproduce or use the image as a sample for sales or self-promotion. This does not include references, but I may use them to promote my species and art.
• I claim no rights to the characters or their designs.
• I honour requests from customers wishing not to have their art included in collections mentioned and anonymity.
• You must credit the design and artwork in such a way that others can easily find the Artist (for example "credit to the designer" is not acceptable because it does not tell others who made the work or design, or where to find them.
• If you repost a character or adopt I've done for you, you must credit me somewhere in the description. A link to my social media is preferred, but if the site does not allow it, then just my username and what website the username is on (ex: Backseat@furaffinity) is fine.
• If the site does allows links, you must use a safe, functioning link back to my page to credit me.

WATERMARKS

• The client is prohibited from removing my watermark from finished pieces I send or editing the piece in any way outside of cropping for an icon.

OWNERSHIP

• I retain all legal rights to my designs. For this reason, my adopts are for non-commercial use only unless you purchase separate commercial use authorization from me. (aka my adopts may not be used in anything that will turn up a profit be it games, books , art pieces,merchandise,comics etc.)
• Once you buy the adopt it's yours to use as you please for non-commercial purposes.
• You may not claim to be the creator of the design, only the owner of the character.
• You must credit me as the creator of the design.

YOU MAY NOT:

• DO NOT DELETE BIDS/CLAIMS! Only bid if you are serious.
• DO NOT Trace, copy, or reference my artwork without my permission exclusively!
• DO NOT Make any changes to the design, including (but not limited to) changing things like colors, gender, clothing, body shape, or adding things like scars/tattoos/piercings. I will do it for a small fee.
• DO NOT Claim the original art as your own.
• DO NOT Resell the adopt for a higher price than you bought it!!
• DO NOT Duplicate/edit the art with intent to sell the results as your own or as part of your own product.
• DO NOT Profit off the use of this art (example: using it as a mascot or face of a commercial project or logo, printing merchandise, or including the art in a book/resource pack with intent to sell.)

[You MAY commission other artists for commercial art of this character design, or profit off of your OWN art of the design. It is only the specific art piece you have purchased from me that is not for commercial use.]

UNDER NO CIRCUMSTANCES IS MY ART ALLOWED TO BE TRACED, COPIED, OR REFERENCED.

YOU MAY:

• Use the adopted character in any personal project, art, RPG, tabletop game, worldbuilding or story you'd like. You may also use them as character art in a streamed tabletop game (even for profit) as long as the art is properly credited.
• Change the design of your character however you want, as long as you do NOT touch my art! You may edit their design in your own art, ask another artist to change some design elements in their own art, or in commissioned art while following that artist’s T.OS.
• Owner of adopt in question is free to use the artwork for icons, pagedolls, character profiles, sites, etc as long as you are not using my work in any way that would go against the T.O.S outlined in this document.
• Use the character adopted from me in any kink content you want, and can have as much NSFW work of them as you like! I am very kink friendly so don’t feel hesitant about doing something “sinful” with an adopt from me. I encourage it!

ORIGINAL SPECIES

You may skip this if it doesn’t apply!

• ​Bionics, Neosi, Roros, Baquit, Kronus, Eternia-Bats, Alaton, Haloscant and Obei are all closed species. They are not free to make. Creation and public posting of unofficial designs is strictly prohibited.
• You may resell the Purchased Rarity Traits for the price you paid for it.
• The owner of a Backseat CS slot is able to have another user design the slot's design for them. Please submit artist credit when sending in a MYO for approval.
• The owner of the Backseat CS slot must be the one to send in the finished design for approval.
• Do not steal/copy/trace anyone else's art/designs for your MYO design, you will get banned from my adopts and art.
• You can turn other characters you have into one of my CS, or give them a CS form HOWEVER: you must get permission from the original creator to do so if you did not design the character yourself! the original creator is allowed to say no, and if you do not ask the original creator the CS form may be voided at their/my discretion.
• Co-Owning designs is allowed! However the politics of that is to be kept between the co-owners and I don't want to be involved outside the initial agreement of who is purchasing the design.
• If trading/reselling/etc a co-owned design: all owners must agree to the trade and trade the design as one owner, you cannot trade “your part”!

DISCONTINUING ORIGINAL SPECIES

• If you would like to discontinue a closed design by me and turn it into a regular human/etc design instead, please note me personally. You cannot discontinue a character without talking to me first.
• You can only discontinue MYO designs you made yourself, or with explicit permission of the MYO designer otherwise (ie: note and ask them, and they are of course allowed to say no if they do not want that to happen!)
• You may NOT create designs within my Custom Species and later remove them from said species without changing any of the anatomy that is unique to said species.
• You may create designs within my Custom Species and then create new, alternate forms/designs with significant changes based upon said design to make them no longer apart of the species.

Visual edits must be made for discontinuation, here is the standard discontinuation options:

FOR HALOSCANTS:

• You can change a haloscant into a regular dragontaur, but you must change their paws, Haloscant’s have 4 toes and 1 grasping digit on their back legs and 3 toes with a grasping digit on their front, you must change this.
• You must remove the Skyplate from their design.
• You must add more spikes or wings to the dragon half of the design - Haloscan’ts are very streamlined and smooth. Lots of dragon plating, thick scales, spikes and wings are encouraged.
• You can just turn them into a human as well.

FOR NEOSI:

• You must remove the subject number tattoo.
• You must remove their species traits. (Their “powers”)
• You can just turn them into a human / demon as well.

FOR BIONICS:

• You must remove their sigils if they are a Sequenced One or Branded.
• You must change their neck from straight, connecting to the back of the cranium with no cranial skull bump with luminescent grooves on the neck to anything else.

FOR ALATON:

• You must change their eyes if they are ancient, If they are not ancient, you must add regular eyes.
• You must change the tip of their tail to smooth or anything else.
• You must change their genitalia to no longer resemble an Alaton’s.
• You must separate their back fluff from their tail.

FOR ETERNIA BATS:

• You must remove their facial masks and make it a regular furry / anthro face.
• You must remove their Eternia Sigils
• You must change their neck and chest pomfs to something more commonly seen on furry/anthro characters.
• You must change their heart-shaped tongues.

While most are likely fine to do, I reserve the right to not allow discontinuation for my species!
